Distance Sales Agreement

This Distance Sales Agreement (hereinafter referred to as the “Agreement”) has been prepared in accordance with the Regulation on the Procedures and Principles of Distance Contracts, published in the Official Gazette dated 13.06.2003 and numbered 25137, and the provisions of the Consumer Protection Law No. 4077.

This agreement regulates the terms of sale of tours, excursions and travel services offered electronically and defines the rights and obligations of the parties.

By completing a purchase on the SELLER’s platform, the BUYER declares that they have read, understood and accepted all terms of this agreement.


ARTICLE 1 – SUBJECT OF THE AGREEMENT

This agreement regulates the terms regarding the sale, payment and provision of tours, excursions and travel services purchased by the BUYER via the SELLER’s website.

ARTICLE 2.2 – BUYER INFORMATION

The BUYER is the individual or legal entity who purchases tours, excursions or travel services via the SELLER’s platform.

The following information provided during registration or reservation:

Email address

Phone number

will be used for all communications regarding this agreement.

Note:

The BUYER is responsible for ensuring that all provided information is accurate and complete. The SELLER cannot be held responsible for problems arising from incorrect or incomplete information.


ARTICLE 3 – SERVICE INFORMATION

Tours, excursions and services are provided as described on the SELLER’s website at the time of reservation.

Service details include the following information:

Tour / Excursion / Travel Service

Duration:

(Half Day / Full Day / Multi-day)

Included Services:

Total price including all applicable taxes and fees.

Payment methods and conditions specified during reservation.


ARTICLE 4 – GENERAL PROVISIONS

4.1 BUYER DECLARATION

The BUYER confirms that they have reviewed and approved electronically the:

price

of the purchased service.


4.2 SERVICE DELIVERY

The SELLER is responsible for providing the services specified at the time of reservation (transportation, guidance, meals, etc.).


4.3 MODIFICATIONS REQUESTED BY THE BUYER

The BUYER may request changes to the reservation such as:

tour date

number of participants

These changes:

depend on availability

are subject to SELLER policies

may require additional charges


4.4 FORCE MAJEURE

If the tour or service cannot be provided due to:

adverse weather conditions

natural disasters

force majeure events

the SELLER will inform the BUYER.

In such cases, the BUYER may choose to:

reschedule the service

receive an equivalent alternative service

cancel the reservation and receive a full refund


ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1 WITHDRAWAL PERIOD

The BUYER has the right to cancel the purchase within 7 days from the date of purchase, provided that the service has not yet been delivered or started.


5.2 REFUND POLICY

Refunds will be processed within 7 business days after the BUYER’s cancellation request.

Conditions:

Full refund for cancellations within the withdrawal period

After the withdrawal period, the cancellation policy specified during booking applies


5.3 NON-REFUNDABLE SERVICES

Some services may be non-refundable due to their nature, such as:

last-minute reservations

event tickets with fixed dates

These conditions will be clearly communicated to the BUYER during the reservation process.


ARTICLE 6 – OBLIGATIONS OF THE PARTIES

6.1 BUYER’S OBLIGATIONS

Provide accurate information

Arrive on time at the meeting point

Follow the instructions of the SELLER or tour operators


6.2 SELLER’S OBLIGATIONS

Provide the service as described during reservation

Evaluate complaints and requests from the BUYER

Inform the BUYER of important changes in the program


ARTICLE 7 – LIMITATION OF LIABILITY

The SELLER is not responsible for:

delays caused by traffic, weather conditions or third-party service providers

personal injuries, accidents or losses not caused by SELLER negligence

service failure due to incorrect or incomplete information provided by the BUYER

The BUYER is responsible for complying with local laws and regulations during the tour.


ARTICLE 8 – DISPUTE RESOLUTION

Disputes arising from this agreement are governed by the laws of the Republic of Turkey.

ARTICLE 9 – FINAL PROVISIONS

9.1 ACCEPTANCE OF TERMS

By completing the reservation, the BUYER confirms that they have read, understood and accepted all terms of this agreement.
